If a Woman Offers Jumuʿah in the Masjid, Is Zuhr Still Obligatory Upon Her?

Question

What do the noble scholars and jurists of Islamic law say about the following: It is known that it is impermissible for women to attend the congregation in the Masjid. But if women offer Jumuʿah salāh in a masjid while observing the complete veil, and the Imām also intends to lead them, will this fulfill their obligation of Zuhr salāh, or will they have to offer Zuhr?

Answer

According to Sharīʿah, Jumuʿah salāh is not fard upon women, and they must offer Zuhr in their homes just like they do on other days. Furthermore, it is prohibited for women to attend the masjid (to join the male congregations), whether to offer Jumuʿah salāh or any other salāh; this prohibition applies in all cases. However, if a woman offers Jumuʿah salāh behind an eligible imām while observing the conditions of iqtidāʾ, and the Jumuʿah itself fulfills all of its conditions (e.g., being in a city or the outskirts of a city, public permission, etc.), then her Jumuʿah salāh is valid, and the Zuhr salāh will no longer remain obligatory upon her.

Jumuʿah is not fard upon women. Thus, it is stated in a hadīth:

قال: الجمعة واجبة على كل حالم، إلا على أربعة، على الصبي، والمملوك، والمرأة، والمريض

Translation: The Noble Prophet ﷺ stated: Jumuʿah salāh is fard upon every baligh (adult), except four: a child, a slave, a woman, and an ill. (Al-Sunan al-Kubrāʾ, Vol. 03, p. 261, Publ. Dar al-Kutub al-ʿIlmiyah, Beirut)

Shams al-ʾAʾimmah, Imām Sarakhsi رحمة اللہ تعالى عليه (d. 483 AH/ 1090 CE) writes:

أما الشرائط في المصلي لوجوب الجمعة فالاقامة والحرية والذكورة والصحة... والمرأة كذلك مشغولة بخدمة الزوج منهية عن الخروج شرعا لما في خروجها إلى مجمع الرجال من الفتنة

Malik al-ʿUlāmāʾ, ʿAllāmah Kāsānī Ḥanafī رحمة اللہ تعالى عليه (587 AH/ 1191 CE) writes:

وأما المرأة فلأنها مشغولة بخدمة الزوج ممنوعة عن الخروج إلى محافل الرجال لكون الخروج سببا للفتنة ، ولهذا لا جماعة عليهن ولا جمعة عليهن أيضا

Regarding the prohibition of women attending the congregation, it is stated in Saī al-Bukhārī, Sunan Abī Dāwūd, Musnad Amad, etc. (cited from al-Bukhārī):

 عن عائشة رضي اللہ عنها، قالت:  لو ادرک رسول ﷲصلی اللہ تعالیٰ علیہ وسلم ما احدث النساء لمنعھن المسجد کما منعت نساء بنی اسرائیل

Translation: It has been narrated from ʿĀʾishāh رضي اللہ تعالى عنها that she said: If the Messenger ﷺ had seen what the women have introduced, he would definitely prohibit them from the Masjid just like the women of Bani Isrāʾīl were prohibited.

Commenting on the aforementioned hadīth, the renowned commentator on Saḥīḥ al-Bukhārī, ʿAllāmah Badruddīn ʿAynī رحمة اللہ تعالى عليه (855 AH/ 1451 CE) writes: 

”قولہ "ما أحدث النساء" أي ما أحدثت من الزينة والطيب وحسن الثياب ونحوها (قلت) لو شاهدت عائشة رضي اللہ تعالى عنهما ما أحدث نساء هذا الزمان من أنواع البدع والمنكرات لكانت أشد إنكارا

Translation: The statement ‘what the women have become involved in’ refers to the beautification, applying fragrance, fine clothing, etc. I say, ‘If Hazrat ʿĀʾishāh رضي اللہ تعالى عنها were to witness the various innovations and unlawful acts that the women have introduced, she would prohibit them more strictly.’ (ʿUmdah al-Qāri, Book of the Salah timings, Vol. 6, p. 158, Publ. ʿAllāmah Zaylaʿī Ḥanafī رحمة اللہ تعالى عليه (d. 743 AH/ 1342 CE) writes:

والمختار فی زماننا المنع فی الجمیع لتغیر الزمان

(Tabyīn al-Ḥaqāʾiq Sharḥ Kanz al-Daqāʾiq, Book of prayer, Vol. 01, p. 140, Publ. Cairo)

If the person whom Jumuʿah is not fard still offers it, their Jumuʿah will be valid, as stated by ʿAllāmah Zaylaʿī Ḥanafī رحمة اللہ تعالى عليه (d. 743 AH/ 1342 CE):

(ومن لا جمعة عليه إن أداها جاز عن فرض الوقت) ، لأن السقوط لأجله تخفيفا فإذا تحمله جاز عن فرض الوقت كالمسافر إذا صام والذي لا جمعة عليه هو المريض والمسافر والمرأة والعبد

Sadr al-Sharīʿah Muftī Muḥammad Amjad ʿAlī ʾAʿzami رحمة اللہ تعالى عليه (d. 1367 AH/ 1947 CE) writes:

جمعہ واجب ہونے کے ليے گیارہ شرطیں ہیں، ان میں سے ایک بھی معدوم ہو، تو فرض نہیں پھر بھی اگر پڑھے گا، تو ہوجائے گا۔

Translation: There are eleven conditions for jumuʿah to become wājib. If any one condition is not fulfilled, it is not fard. But even then, if one offers it, it will be valid. (Bahār-e-Sharīʿat, Vol. 01, pt. 04, p. 470, Publ. Maktaba-Tul-Madinah, Karachi)

If they offer Jumuʿah salāh, the Zuhr salāh will no longer be necessary, as stated by Malik al-ʿUlāmāʾ, ʿAllāmah Kāsānī Ḥanafī رحمة اللہ تعالى عليه:

هؤلاء الذين لا جمعة عليهم إذا حضروا الجامع وأدوا الجمعة فمن لم يكن من أهل الوجوب كالصبي والمجنون فصلاة الصبي تكون تطوعا ولا صلاة للمجنون رأسا، ومن هو من أهل الوجوب كالمريض والمسافر والعبد والمرأة وغيرهم تجزيهم ويسقط عنهم الظهر

ʿAllāmah Ibn Nujaym Misrī Ḥanafī رحمة اللہ تعالى عليه (d. 970 AH/ 1562 CE) writes:

(ومن لا جمعة عليه إن أداها جاز عن فرض الوقت)۔۔۔وأما من كان أهلا للوجوب كالمريض والمسافر والمرأة والعبد يجزئهم و يسقط عنهم الظهر

(Al-Baḥr al-Rāʾiq, Vol. 02, p. 164, Publ. Dār al-Kitāb al-Islāmī)

وَ اللہُ اَعْلَمُ عَزَّ وَ جَلَّ وَ رَسُوْلُہ اَعْلَم صَلَّی اللہُ تَعَالٰی عَلَیْہِ وَ اٰلِہٖ وَ سَلَّم

(Allah Almighty knows best and His Messenger صَلَّی اللہُ عَلَیْہِ وَ اٰلِهٖ وَسَلَّم knows best.)
