Question

What do the Islamic scholars and Muftis of the sacred Shariah say regarding the following: My wife has three Tolas of Gold and a silver jewellery set but she does not have any cash to buy an animal to sacrifice or to buy a share of a sacrificial animal. Can she sacrifice an animal with the money borrowed? Will her Wajib be fulfilled?

In the case questioned about, sacrificing an animal is howsoever Wajib therefore she must perform it. If she borrows money and performs the sacrifice, Wajib will be fulfilled.

It is mentioned both in Fatawa Razawiyyah and Amjadiyah and the exact words of the first are as follows: If the sacrifice is Wajib for a person and he has no cash on him for the time being, (he has to sacrifice an animal) whether he does it by borrowing a loan or selling some of his belongings. (Fatawa Razawiyyah, vol. 20, p. 370, Raza Foundation, Lahore)

It is mentioned in Waqar-ul-Fatawa: Sacrificing an animal is Wajib for everyone who possesses Nisab (minimum threshold); (if one has no cash on him) for sacrificing an animal, either he has to sell his gold and silver or borrow a loan. He has to act upon either of the above-mentioned choices. (Waqar-ul-Fatawa, vol. 2, p. 470, published by Bazam-e-Waqar-ud-Deen, Karachi)
