Question
What do the
scholars of Islam and Muftis of the blessed Shari’ah
guide regarding the matter that:
A person has not
made sacrifices for the past five (5) years while they were Wajib
to him. Now should he give Sadaqah (charity) of the
cost of one goat only for each Qurbani sacrifice or is it permissible to give Sadaqah of five (5) shares in a cow? Qurbani was Wajib for him but he had not purchased any animal.
Just like the
amount of Zakah can be donated in the construction of
Madrasah after doing a Shar’i Heelah,
can the amount of previous sacrifices that is
obligatory to pay off also be donated in the construction of Madrasah after
doing a Shar’I Heelah?
بِسْمِ اللہِ الرَّحْمٰنِ الرَّحِیْمِ
اَلْجَوَابُ بِعَوْنِ الْمَلِکِ الْوَھَّابِ اَللّٰھُمَّ ھِدَایَۃَ
الْحَقِّ وَالصَّوَابِ
If
someone has not made Qurbānī sacrifices for
five (5) years without any (valid) excuse, he will be a sinner due to leaving
out this Wājib act; he must repent of it. It is Wājib to him to give Sadaqah
of the cost of a goat only for the Qurbānī
sacrifice of each year. It is not allowed to give Sadaqah
of the cost of shares in cow as only this ruling is stated in the books of Fiqh
in this case.
Yes, the amount of Qurbani sacrifices of
previous years can be utilised in the construction,
etc. of Madrasah after doing a Shar’i Heelah. Since it is Wajib Sadaqah and this is the ruling for Wajib
Sadaqah e.g. Zakah and Sadaqah al-Fitr.
